4. Payments

4.1 Deposit & Final Payment

Bright Dawn requires:

• 50% deposit to secure your booking and begin pre-production
• 50% final payment due upon project completion and before delivery of final files

Deposits are non-refundable unless otherwise stated in writing.

4.2 Accepted Payment Methods

We accept payments through secure third-party processors. You agree to provide accurate billing information.

5. Cancellations & Refunds

Client-Initiated Cancellations

• Cancellations made 7 days or more before the scheduled project date may receive a partial refund of the final balance (not the deposit).
• Cancellations made within 7 days of the project date may be subject to full project charges due to reserved time, staffing, and preparation.

Bright Dawn Cancellations

If we must cancel due to emergency, illness, weather, or equipment failure, we will:

• Reschedule at no additional cost, or
• Provide a refund of any payments made

We are not responsible for indirect or consequential losses resulting from cancellation.

6. Ownership & Usage Rights

Unless otherwise agreed in writing:

6.1 Ownership

• Bright Dawn retains copyright ownership of all photos, videos, and creative works produced.
• Clients receive a usage license based on the package purchased.
• It is the client's responsibility to save all footage shared with them depending on the package purchased. Bright Dawn is not responsible for saving footage after purchased packages are delivered.

6.2 Included Usage Rights

All packages include:

• Unlimited web and internal marketing usage
• Social media usage
• Portfolio usage for the client's business

6.3 Additional Usage

Commercial advertising rights (broadcast, paid ads, large-scale campaigns) may require an extended license or additional fee.

6.4 Restrictions

Clients may not:

• Sell, sublicense, or transfer media to third parties
• Alter or edit media in a way that misrepresents Bright Dawn's work
• Remove watermarks without permission

7. Client Responsibilities

Clients agree to:

• Provide accurate project details and expectations
• Secure necessary permissions for filming locations
• Ensure subjects or participants are aware of filming and have given consent
• Provide safe working conditions for our team
• Review proofs and deliverables in a timely manner

Delays caused by the client may affect project timelines.

8. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for:

• Their content
• Their privacy practices
• Any damages or issues arising from their use

Accessing third-party sites is at your own risk.

9. Disclaimers

Our website and services are provided "as is" without warranties of any kind, including:

• Accuracy
• Availability
• Fitness for a particular purpose

We do not guarantee uninterrupted access to the site or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, Bright Dawn and all its affiliates are not liable for:

• Indirect, incidental, or consequential damages

• Delays caused by weather, equipment failure, or unforeseen circumstances

Our total liability for any claim is limited to the amount paid for the specific service in question.

13. Model Release

By engaging Bright Dawn for photography, videography, or related media services, you grant us the right to:

13.1 Rights Granted

• Photograph, film, or record you and any participants involved in the project
• Edit, retouch, crop, or modify the media as needed
• Use the media for Bright Dawn's portfolio, website, social media, marketing materials, and promotional purposes, unless otherwise agreed in writing

13.2 Client & Participant Consent

You represent that:

• All individuals appearing in the media have given consent
• You have the authority to grant permission on behalf of minors or employees
• You will notify us in advance if any participant does not consent to being photographed or filmed

13.3 Revocation

If you wish to revoke the model release for future use, you may do so in writing. Revocation does not apply to:

• Media already published
• Media included in printed materials
• Media used in completed campaigns

13.4 Exceptions

If your project requires confidentiality (e.g., unreleased products, internal corporate content), Bright Dawn will honor any written non-disclosure agreement.
